what happens when credit card fraud happens?
my mother has just been a victem of credit card fraud.... she went to the bank and she OWED the bank over $1,000
so we filed a fraud report so we are curious what would happen to the person who took the card if that person got caught??

First, I assume that the bank was told that the card was stolen (or compromised). If not, STOP READING AND GO CALL THE BANK NOW!
If the person is caught, they will be arrested and tried for fraud, but that doesn't get you your money back. You will need to get a lawyer and sue the person if you want to try to collect from him/her.
However, since you say that your mom went to the bank and found that she owed them 1000, it sounds like this is not a credit card, but a debit card. She can dispute the fraudulant charges, but you will need to look at the debit (or credit) card agreement to find out about the process. Also in the agreement, there should be details about what responsibility your mom has (had) in reporting (timeline, etc.) and how much she will be responsible for if she met the requirements in that timeline.

ok first of all,your mom will go through alot of hassle with the creditors to prove it was not her.She will have to make police reports and sign in documents from the creditors and like I said a few hassles here and there.Now to answer your question,the person that stoled your moms' card or took or even found is considered theft because they did not turn in ,instead took out money,so the only bad thing that will happen to the person is jail time for theft,thats it.Now if the person never gets caught or its not proven to be someone else,The Creditors will make your mom pay.
Your mom may be a victim of Identity Theft. This just happen to my office associate. It started out like your mom's case, then the thefts started going through a setting up accounts in other banks in her name and running up charges. What final helped my associate was 1) file a police report, 2) file a report with the FBI which you can do online, 3) report the ID theft to the credit bureaus, the credit bureaus will notify any bank setting up new credit that the person has had ID theft and not to allow credit without first calling your mom and getting a password from her to allow the credit card/loan to proceed. The credit bureaus will monitor your mom's new account set up's for 5-7 years. Basically law enforcement did nothing for my friend, but the credit bureaus stopped any further damage. The credit bureaus will provide a free credit report to your mom so she can see if there are accounts opened that she doesn't know about, so she can get those accounts which are fraudulent shut down.
