Would you file a complaint with the FBI or Internet Fraud site?

The company has messed around and is supposed to fix my product. In essence, they keep me on the net for a couple of hours and always seem to find something they want to sell me that they say I need. The product is still not working right after two months and at least ten phone hours. So, since this is happening on the Internet, would it be Internet fraud or FBI case? Hopefully if others have had problems with Dell on Call, they will also file. Please help. NO I DO NOT SUE-OR HAVEN'T YET. THERE IS ALWAYS THE FIRST TIME.

No, this is not a case for the FBI. The FBI only investigates federal offenses (crimes involving interstate commerce, or involving more than one state). What you have is a civil tort (the company is not honoring its warranty obligations). I assume you are talking about a software product. Small claims court is the place to go. You can file a claim in the place where you purchased the product, or in your county of residence, since it is in your state where the original sale transaction was (legally) consummated. You have a right to receive the purchase price of the product back plus (in many states) costs incurred due to the failure of the product. Furthermore, if you can prove that the failure to honor warranty obligations was willful, then you may be entitled to treble damages (thrice the original cost of the software, plus expenses). If you really want to report this case to a federal authority, the you might consider filing a complaint with the FTC (federal trade commission), since the Dell computer company is making representations about its products in interstate commerce. Go to www.ftc.gov. Go to the website for your state to learn how to file a small claims case. It is likely that the computer company may simply settle the case, since sending a lawyer out to your neck of the woods would be very expensive for them.
